Terms & Conditions

By entering a consumer contract with Aldini for the supply of goods, you agree to and accept to be bound by these terms and conditions and understand that your purchase is subject to these terms and conditions.

RETURNS, REFUNDS AND EXCHANGES POLICY

Aldini encourages you to take your time in deciding on your purchase as we do not offer refunds, exchanges, or returns for change of mind. This includes orders which have not been shipped. Please understand that all images used are for illustration purposes only.

If a refund or exchange is agreed to by Aldini there may be an administration and/or handling fee. Please note that delivery charges and the cost of returning the product/s are not credited to the customer. Once a product has been shipped, even if it has not yet arrived at its intended destination, shipping costs are not refunded to the customer. In the event that shipping is free, the shipping costs incurred to deliver the order to the customer will be deducted from the final invoice.

All returns must be in their original packaging and present in a way that would allow Aldini to resell the product. Unfortunately, we cannot accept any returns where the original packaging has been ripped, damaged, or discarded. 

We reserve the right to refuse a return in cases where we deem damage to a product to be due to fair wear and tear, misuse, and failure to use in accordance with manufacturer’s instructions or failure to take reasonable care which includes the use of cleaning products or chemicals which are potentially harmful to your Aldini product.

Upon receipt of the returned goods, we will inspect your product and a credit will be processed within 7 working days. 

Subject to any warranties which may be implied by law, Aldini will only consider claims for any manufacturing faults or inherent defects on its products where any such faults or defects are brought to its attention, within 12 months from date of invoice.   

Aldini takes no responsibility and gives no warranty for the accuracy of any dimensions or measurements furnished to it by purchasers (or any person on their behalf, including any person of Aldini) in respect of areas and surfaces upon which its product will be laid or fixed.   

To initiate your return, please email through to your Aldini representative, images of your product, your order number and any supporting details relating to your product and its return including an explanation of why you have requested the return.  

Returns, exchanges, and refunds are considered void 60 days from the purchase date if the product/s remain uncollected or the customer delays the delivery date, where a product is in stock and/or available for pick up or delivery.

CREDIT FOR RETURNS

Credit for returns will be given only on the following conditions: 

a) A copy of the final invoice on which the goods were purchased must be produced; and
b) Notification regarding your intention to return the goods must be received by Aldini within seven (7) days of the delivery/pick up date and returned within twenty-one (21) days of the delivery/pick up date; and
c) The goods will only be accepted if they are in good order and condition and of current stock. Where applicable, the goods must be in full and unopened boxes or packaging; and
d) Returns of sale items, second/commercial quality, special/specially ordered items or non-standard material will not be accepted; and
e) Claims relating to damaged goods, incorrect or short supply must be made within twenty-four (24) hours of delivery date. No claims will be recognized after such time.
f) A receipt note must be obtained from ALDINI in order to substantiate the return of goods; and 
g) Any credit for goods returned will be made at the rate equal to the purchase price less a handling charge of 30%; and 
h) Any freight cost into our store is the purchaser’s responsibility; and
i) Goods in shades no longer kept in stock by ALDINI will not be accepted.

CANCELLATION

ALDINI reserves the right to cancel any order which it cannot fulfill for a reason or beyond its control.  

ALDINI reserves the right to refuse cancellation by you of any order if the goods have at the time of your cancellation request, been dispatched from the manufacturer; or have already been ordered from the supplier; or are already held by ALDINI. 

SPECIAL/CUSTOM ORDERS

Special and Custom orders begin production almost immediately upon order placement and are manufactured to your specifications. Therefore, a product which is special or custom ordered from Aldini cannot be returned, cancelled, or changed at any time.  

For special orders, payment is required in full and cannot be refunded at any point. Once delivered, special order returns or exchanges due to custom preference, change of mind or any other reason cannot be accepted. Please note that all shipping and freight charges are non-refundable and are the customer’s responsibility.

PRICING

The price listed on your most recent invoice supersedes all previous prices quoted to you whether done so orally or in writing.

Any and all prices quoted on any price lists produced by Aldini are subject to change at any time without prior notice. 

PICK UP/DELIVERY

All invoices issued to you by Aldini in relation to your purchase must be paid in full prior to delivery or pick up of your good. 

Aldini reserves the right to refuse pick up and/or delivery of your good until such a time as all your liabilities to Aldini in relation to the good are satisfied. 

ALDINI is entitled to charge a storage fee, at a reasonable rate to be determined by ALDINI, if the pick-up/delivery of goods is refused due to non-payment by you of any invoice relating to the good for which pick up or delivery has been refused.

Aldini reserves the right to cancel orders at its discretion if the goods are not taken within fourteen (14) days from date of final invoice. 

Any deposit made by the purchaser will be non-refundable except with the agreement of Aldini in its absolute discretion. 

All pickups are to occur from the Aldini warehouse unless prior arrangement had been made between you and Aldini.

You must inspect all goods upon delivery or pick-up. You must notify Aldini within 24 hours of delivery or pick-up if the goods are not in accordance with your purchase order. After this period has elapsed, the goods in their current description and condition will be taken to have been accepted by you.  

If at the time of delivery or pick-up, the goods and or their packaging look significantly damaged, you should refuse to accept the goods. Further you should take a photograph of the packaging or goods and send these photographs immediately to Aldini. You understand that if the damage to the packaging and/or product is found to not be significant and a further delivery of the goods is to be made, any costs associated with the additional delivery will be paid by you.

Aldini can only arrange for delivery across the Commonwealth of Australia. 

MAINTENANCE 

Aldini will not be liable for any claim arising from damage to the goods which is caused by the use of any acids or chemical compounds, or solvents used in the cleaning of those goods. This is irrespective of whether the cleaning was done by Aldini or the purchaser, provided it was done at the purchasers ’request.   

Aldini recommends that immediately after fixing the products, suitable protective measures are taken to avoid unnecessary damage to the goods. Some ceramic glazes particularly gloss finishes, can become scratched by foreign abrasive material during installation and Aldini is not liable for any claim relating to damage either caused as a result of installation, or damage after installation.  

The goods are only guaranteed against crazing to the extent given by individual manufacturers.   

APPLICATION OF THE AUSTRALIAN CONSUMER LAW

The supply of goods by Aldini is subject to the guarantees relating to the supply of goods under the Australian Consumer Law. 

As a consumer, you are entitled to the following guarantees from Aldini in relation to all goods supplied to you where they are applicable to your purchase: 

1.     Guarantee as to title.

2.     Guarantee as to undisturbed possession.

3.     Guarantee as to undisclosed securities.

4.     Guarantee as to acceptable quality.

5.     Guarantee as to fitness for any disclosed purpose.

6.     Guarantee relating to the supply of goods by description.

7.     Guarantees relating to the supply of goods by sample or demonstration model. 

8.     Guarantee as to repairs and spare parts.

9.     Guarantee as to express warranties.

The guarantees provided by the Australian Consumer Law cannot be excluded by contract and are in addition to any extended warranty purchased by you.

In the event that Aldini fails to comply with a consumer guarantee and is required by law to remedy that failure, Aldini reserves the right to first seek to remedy the failure by way of repairing or replacing the goods as opposed to by way of refund.

In the event that Aldini fails to comply with a consumer guarantee and that failure either cannot be remedied or is a major failure and Aldini receives notification from you in which you reject the goods, Aldini reserves the right to first seek to replace the rejected goods with goods of the same type and of similar value if such goods are reasonably available to Aldini prior to providing a refund. 

You will not be entitled to a remedy in the following circumstances:

1.  You have had a change of mind after placing your order;

2.  There is a slight variation in the dimension of the goods;

3.  The goods have been damaged by you;

4.  The damage is limited to the packaging only;

5.  The damage of the goods is due to normal wear and tear;

6.  The damage has occurred due to improper assemble or modification by you;

7.  The damage has been caused due to abnormal use of the goods;

8.  The damage is as a result of the lack of maintenance and/or care by you.

You acknowledge and agree that due to the inherit nature of natural stone and ceramic products, shade variation from shipment must be anticipated. No claims concerning shade variation can be accepted.

You agree that Aldini’s liability for damages is limited to the total price paid by you for the goods purchased from Aldini to which any claim or complaint relates.

CHOICE OF LAW AND EXCLUSIVE JURISDICTION CLAUSE

These terms and conditions and any contract to which they apply shall be interpreted and governed by the laws of New South Wales and the parties submit exclusively to the jurisdiction of the Courts of New South Wales whether they be exercising state or federal jurisdiction in relation to any claim, suit, action or motion brought in relation to these terms and conditions and/or any contract to which they apply.

SEVERABILITY 

In the event that any particular provision of a consumer contract entered into by you with Aldini for the supply of goods contravenes the Australian Consumer Law or is otherwise void or invalid, the contract remains legally binding and enforceable save for the provision that has been declared void or invalid in so far as that provision is severable. 

FORCE MAJEURE

ALDINI will endeavour to meet all estimated delivery/pick up dates for its products however, will incur no liability for any delay caused by events beyond its control.  Aldini incurs no liability for any failure on its part to comply with any term or condition contained herein where such a failure is caused by events beyond its control.

AMENDMENTS

Aldini may from time to time amend these terms and conditions without prior notice to you. The latest version of the terms and conditions will be published on the Aldini website.
